What if I am working?

 

Do you or your partner, together, in a year have a total income from all sources before tax or any other deduction, of more than £12, 475?

  • If the answer to this question is no, You should automatically pass the means assessment for Legal Aid

  • If the answer to this question is yes, You will need to complete a full means assessment for legal aid which will also take into consideration some outgoings such as rent or mortgage payments (after taking away housing benefit), childcare costs for any children who live with you, maintenance to any ex partners… etc Please refer to the below chart for your reference

I am self-employed

The courts request a lot of information in order to consider your eligibility for legal aid when self employed. Some of these questions include: Total turnover over the last 12 months, Total drawings over the last 12 months, Total profit over the last 12 months, Percentage share of profit, Director's salary or remuneration received, Total income from share sales, the trading name of the business or partnership, the trading address or registered address. You will also be required to provide evidence such as your P60 or tax calculation sheet (form SA302) & complete financial accounts. Eligibility depends on the answers to these questions.
