Will I get Legal Aid in the Magistrates Court?

Please appreciate each situation is individual and we can only advise on the guidelines in place.

There are two tests to be considered when applying for representation through public funds for your court case.

  1. Means Test - This takes into consideration your financial circumstances and if the Court feels you are in a position to pay for your representation by yourself/ you are deemed not to be in need of assistance through public funds. Please be aware that if you are married or living with your partner their finances will also be considered and your income will be assessed as one.

  1. Interest of Justice Test - this means: is your case considered serious in that you are likely to receive a custodial sentence if convicted. If you are under the age of 18 Years (considered a Youth) you will automatically be eligible for Legal Aid.
